Sorry Trashman but what I said before is wrong. I check my email at work today and ABC casting says the DVD needs to be on their desk by Wednesday, the 31st. That means I have to film and edit the video tomorrow. Slam-dunk (basket ball term) and in the can. My videographer is gone to Sedona Arizona at a film festival this weekend. One of his movies is being shown. This really may be good news though. As he came from a film background, including the original Star Trek film, his plan for this was a big production.
My understanding from ABC is that they just want to see how I look and act on film. They do not want to get a min Star Trek episode at this point. That is what Paramount will provide if anyone does.
Thank you Skeeter. I got a second 30-day trial of software to unzip, renamed the file back to rar and it looks great. In fact it is exactly what I needed. My video is to show me pitching my concept for the competition. The pictures make it look better. Your pictures are perfect for that mate.
I pulled in some favors for studio time by dropped the name of the well know organization supporting me. The backup crew and I film and edits tomorrow. Monday I will send by next day mail the DVD to the Los Angeles California offices of ABC casting. I know you all wish me luck. Win or loose we are all on the team. Thank you for your support.
I will leave the name of BOTF II out of my project until or unless someone esle here chose to inquire with Paramount. It will not go down like what you see here.

Hang on down there. I will beam you all out as soon as the transporters are back online, the asteroid changes course, and Q and the Klingon, Romulan and Borg ships leave us alone and when I am done with the nude love scene.
I did forget to make note of how good Skeeter's models look. It is best Paramount not know the truth. They would feel upstaged. 8O

okay, I may have gone a bit too far here before, but whatever, it needs to be said and it needs to be considered, well maybe better in the staff room here and not public..
okay, checked everything now via google and news are not very good. Hasbro Interactive (which was bought by Infogrames aka Atari in 2003) and Atari have sued several times against smaller communities which produced homebrew games for the "real" old Atari computer and they sued successfully several games sites for allowing old games to be played in multiplayer over their site. Google for it, you find the atariage forum there for example.
gavin and zach said ( http://209.85.135.104/search?q=cache:oG ... ient=opera )they don't know about legal status and I think/strongly think he was asked/demanded to withdraw his project back then after having asked for permission on his own. That would totally coincide with my recent findings and his sudden leave, but as I said, only guesswork.
Jig if you read this and get more and more angry about me not being whiter than white (you might remember that post of yours about this site should stay whiter than white 2 years ago ) then edit my posts and/or delete them.
But there's one thing, infogrames/atari is tough on legal stuff (also they seem to clash with paramount even regularly or was it activision?..doesn't matter. The point is, we aren't really safe in here considering how many google links already point here if you type just botf in your browser..), you find that all over the net and if they get their eyes on our alpha, they'll probably have us kicked in the ass.
it's just that I will not stand in the front line and I think (but I don't know of course) sir p. doesn't want that either. I mean we are definitely the first and the first to kill if something happens......
think we have to talk this out of the world first, I mean there must be a solution and I say this as a mathematician lol

indeed, it's better to discuss this in the staff room. Also i seriously doubt that Gavin left this. First, he didn't say anything about this to me nor (i think) to jig about this. Prob stuff got in the way. Also gav came later again online for a short period of time. But let's not speculate on this to much.
Infogrames doesn't hold the rights anymore. I think Perpetual Entertainment does now.

well okay, I let sir p. decide to take this offer (about talking it out in the staff room).
Well it's speculatius talking about gavin but if you really read that interview I linked above (and I did just that a minute ago) then you ask yourself what and why we are all here exactly
I mean it sounded like all was done, even C&C ground combat, howdydoodistuff and everything was fine. was that just not a bit too fine for being true.. ?
well I certainly liked to have had the opportunity to take a look at his game.
Just a waste he didn't hand out at least something, but well, let's not dwell about this cold coffee and keep our mouths lol shut.
btw. this perpetual entertainment thing is worthy to check out, will do that in a second right now
haven't read that atari sold the botf licence cause well they are the last one in the buying off list (microprose->(&)hasbro interactive->infogrames/atari->(?)perpetual entertainment..)

It seems Viacom Consumer products (?) sold the rights to create massive multiplayer game for pc to Perpetual Entertainment.. And viacom is owned by paramound i think ?...

sure, but that's a whole other story (the MMORPGs are somewhat different to turn-based games like botf). Perpetual Entertainment could possibly be dangerous to already existing Startrek fanmade MMORPGs but not us.
Viacom and Paramount are always to be considered "dangerous" (in a lack of a better sounding word here) cause they give the license away for the Star trek content. But since we take no money and botf isn't on sale anymore except (!) on ebay which could lead to a private civil lawsuit from an angry gamesseller maybe (but this chance is as low as 1E-17, virtually zero), no real harm is done here.
I am more concerned about this atari/infogrames company which seems to be in deep financial troubles since last year (check for the news via google).
They still have the full rights on botf and everything derived from botf or made look like a derivation/sequel to botf. So they can right now kick us in the butt IMO.

perpetual only have a licence for the mmo, bethesda have a licence for any genre type i believe. gavin never got a c&d order, harry lang himself knew of this project and there has been to problems at all with paramount, who btw own all the licences. atari/infro can only issue c&d orders on games they own full title to, they only had a licence for trek games which is long gone. i know this is a legal grey area, mgm had some stargate mods shut down as they were worried about loseing mony when the sg1 games start coming out, however paramount have yet to launch a legal battle to stop any fan based games or mods.

Yes. The video for ABC casting just went out by express mail. It is in the hands of fate now.
A special thanks to Trashman and Jigalypuff for the additional pictures. The graphics were just in time and very helpful. You guys really do great work.
It may be that what I proposed will be viewed as too both dark and compelling for what the ABC producers have in mind. They may be looking for both light and nasty TV formula. If they are looking for a group of guys that live in their mother's basement and dress up like Klingons to then fight it out in a reality TV competition setting - well then all is now lost. You will all see why and understand soon enough.
Even if this project goes no further than this we can still have a good time with it. If I am accepted to this competition there will be more work to be done. You can all help me at this stage. To prepare for the competition of Star Trek dreams I will want to see what your ideas for a Star Trek fantasy are. Tell me what you would have ABC and Paramount do for you. Why is your idea more deserving than the next guys? I will start a new thread. We can leave this thread now to the legal discussion. Look for Star Trek 101. Have fun, be nasty or nice but make a compelling case. I will learn how to deal with your ideas by how you deal with each other’s.
Thanks for your support.

well, good luck on your vision of star trek. I think they may be open to a darker side of st since these bright&shiny ones kinda failed lately (though ST is - as of now - no dark universe but I kinda liked the ds9 episode siege of AR-518, that was a real good one and they'd shown some non-bright sides of the federation there..)
to get back to the legal stuff, hm, I found something promising and it sounds like something that is sensible.
quotes:
Wikipedia wrote: Cow Creek Films, the production company at the time for Star Trek: New Voyages, had contact with Paramount to successfully reverse a cease and desist order which resulted in a set of guidelines being verbally agreed on: No profit can come from the film. It cannot be shown in festivals or at conventions or any other venue where money is charged for admission either directly for the film or the event itself. It can only be a free download and cannot be offered in lieu of a "donation". They were NOT giving permission to do the show, but rather turning a blind eye to it as long as the producers stick to the rules.
It should be borne in mind that there has never been any independent corroboration of this - Viacom has been consistently silent on the subject - however the source, Jack Marshall the Executive Producer at the time, is trustworthy. What is more, the subsequent success of "Star Trek: New Voyages" and the prominent collaboration of ex-Paramount cast and crew would suggest that Paramount know about them and are giving their tacit permission.
Jack Marshall from Cow Creek Films mentioned in the quote above wrote: GS: What is your arrangement with Paramount and did you have any trouble with their legal department over copyright issues?
JM: Paramount says we can do the show as long as we don’t make money from the show. As long as we follow this simple rule, we’re all good!
GS: Has Paramount shown any interest in New Voyages beyond their legal issues?
JM: Yes!
blog-site below wrote: wildblue I suggest that you ask Paramount for their current licensing standards to fan productions. I believe that awhile back (many years ago) Paramount published a letter in which they explicitly stated that fans are allowed to use Star Trek logos, characters, videos, etc, WITH THE CONDITION that no money may be earned by the production or distribution. I’d suggest that you contact them to ask what their current policy is, and get it in writing or by email. And yes, I would very much like to see 202 act 1. - icapo, (junior college student) If this is the case, then you should fully reference that agreement at the opening of any release sourcing footage from Trek. I have some experience with copyright, so I’d be more than happy to look into the legality of anything you’re planning to release. - ‘areakt’, (R. Caves, HF Executive Producer, BBS Administrator Any copyright knowledge or expertise would be appreciated. You’ll need to view the file, so contact me for the SECRET download link… Rob - ‘/carlos’, (C. Pedraza, Hidden Frontier co-producer) People often confuse copyright and trademark. From a legal perspective they’re two very different things. Many people assume that Paramount is trying to protect its copyright on all things Star Trek, or it will “lose it,â€￾ resulting in Trek falling into the public domain. That’s not how it works. Copyright is something Paramount retains to its creative property no matter how much people try to copy their work. Under copyright law, Paramount is justified to sue anyone for monetary damages that stem from commercial distribution of its property. Copyright never unwillingly falls into public domain. Trademark is different. Paramount can lose its claim on the trademarks associated with Star Trek if it doesn’t defend them. A trademark covers only such things as names, logos, slogans, color combinations, and product design. The trademark must be used commercially by an individual or company. Unlike copyright, Paramount can lose its claim to trademark. Just like the companies Xerox, Kleenex and Dumpster work hard to remind people they own those trademarks. If they let them become generic terms for photocopying, facial tissues and large garbage bins, they can no longer make any money using those terms exclusively. Anyone could use the term Kleenex to sell their tissues. The issue with “Yesterday’s Excelsior,â€￾ Act 1, is specifically copyright because of the use of actual footage from the ST movies. I doubt Paramount would specifically allow their use. But at the very least, any use by HF of photos, footage or any other creative property actually produced by Paramount should explicity acknowledge the proper copyright ownership is included in the episode. So at least no one can be accused of trying to claim a specific creative was an original production. HF, like any fan fiction, is properly regarded as a “derivative work,â€￾ subject to no copyright protection of its own. (***Editors note: HIdden Frontier is NOT this because no permission was granted by Paramount for their videos.) Check out New Voyages’ legal disclaimer at the footer of their homepage to see how they present the explicit acknowledgement of Paramount’s copyright. For its part, Paramount suffers fan fiction or fan films only at its pleasure. Clear as mud? Regards, /carlos

hm, so I think, a verbal agreement can be reached with paramount or a written one that we are obliged not to show anywhere or get serious penalties. It looks like we don't need that explicitly but I could sleep better if I had one of those in my hands but I doubt paramount cares about my sleep so it's up to others to decide what to do now.

That does sound promising. Although I have to admit that us discussing legal issues in open forums does make me somewhat uneasy.

Just some Followup for those that remember this thread; The show was so bad it was pulled off the air before they could get to the Star Trek episode. Once I learned of how shallow the "contests" were I was glad I had not gone any farther with it. I would not have myself a clown in the media circus just to get on TV. Only a benefit for children with cancer could get me to follow through and that was clearly too serious for these people.
